es777's total aggregate liability to you for any claim arising out of or relating to these Terms or your use of the Platform shall not exceed the total amount deposited by you in the twelve (12) months preceding the event giving rise to the claim.
Nothing in these Terms shall limit or exclude es777's liability for fraud, gross negligence, or any other liability that cannot be excluded under Philippine law.
es777 collects and processes personal data in accordance with the Philippine Data Privacy Act of 2012 (Republic Act 10173) and our Privacy Policy, which is incorporated into these Terms by reference. If the dispute cannot be resolved through negotiation within thirty (30) days, it shall be submitted to the exclusive jurisdiction of the appropriate courts of the Republic of the Philippines.
Nothing in this clause shall prevent es777 from seeking injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.
